SHIPBYMAIL – TERMS & CONDITIONS AND PRIVACY POLICY

ShipByMail.com ("ShipByMail", the "Company", "we", "us") is committed to protecting the privacy and rights of our users while ensuring transparency and legal compliance in all aspects of service delivery. This document outlines the Terms & Conditions and Privacy Policy that govern your use of our services, sites, and tools, effective as of the date above.
1. DEFINITIONS
User: Anyone who uses ShipByMail's services or visits our sites.
Member: A registered user who provides personal data for account creation and service use.
Personal Data: Any information that identifies a user as an individual.
Sites: Refers collectively to ShipByMail.com and all subdomains or associated tools.
2. USER AGREEMENT
By using our services or Sites, creating an account, or communicating with ShipByMail, you agree to comply with and be bound by the terms outlined in this document. 4. TERMS OF SERVICE
4.1 Services Offered
ShipByMail offers package forwarding, consolidation, inspection, export handling, and return processing for individuals and corporate clients. Users must:
- Ensure accurate address and account details
- Pay all applicable fees and charges
- Use services lawfully and ethically
4.2 Member Obligations
Members agree to:
- Not use ShipByMail addresses for residency or business representation
- Comply with all applicable import/export laws and restrictions
- Avoid prohibited or restricted items (as listed on our site)
4.3 Fees and Charges
All services are billed based on weight (actual or dimensional), volume, or service type. Memberships auto-renew unless canceled. Storage beyond 30 days is billable. Late payments may result in forfeiture of goods.
4.4 Corporate Clients
For returns and bulk processing:
- ShipByMail acts as the Canadian return depot
- Returns are consolidated and forwarded as instructed
- Custom SLAs may be established in writing
4.5 Insurance
- Insurance is optional and priced per $100 CAD of value
- Claims must be submitted within the specified window (typically 60 days)
- Exclusions apply (e.g., electronics, jewelry, backorders)
4.6 Fraud Prevention
Users must provide accurate, truthful data. Any suspected fraud will result in account suspension and potential legal action.
4.7 Indemnification
Users agree to indemnify ShipByMail for any liabilities arising from misuse of services, illegal conduct, or violations of these Terms.
4.8 Termination
Accounts may be terminated for:
- Non-payment
- Breach of Terms
- Violation of law
Terminated accounts forfeit any unclaimed goods and prepaid fees.
4.9 Class Action Waiver & Arbitration
Disputes must be resolved through binding arbitration in British Columbia, Canada. Users waive the right to participate in class actions where allowed by law.
4.10 Force Majeure
ShipByMail is not liable for delays or failures caused by events beyond our control (e.g., customs closures, pandemics, natural disasters).
5. PROHIBITED USES
The Terms strictly prohibit:
- Use of the Site for illegal or fraudulent purposes
- Transmission of malware or spam
- Harassment or abuse of ShipByMail personnel
- Resale of restricted goods or re-export of forwarded merchandise
- Use of the address for business licensing or personal residency
6. FINAL PROVISIONS
This Agreement is governed by the laws of British Columbia, Canada. Users agree to submit to the jurisdiction of BC courts and waive any claim that such forum is inconvenient.
